Terms & Conditions

These Terms & Conditions apply to memberships, subscriptions, bookings, classes, activities and services provided by Fraserburgh Fitness Centre.

By creating an account, purchasing a membership or subscription, booking an activity or using Fraserburgh Fitness Centre facilities, you agree to these Terms & Conditions.

Where a parent or guardian creates an account, purchases a membership or makes bookings on behalf of a child or dependant, the parent or guardian accepts these Terms & Conditions on their behalf.

1. About Fraserburgh Fitness Centre

Fraserburgh Fitness Centre provides gym facilities, martial arts classes, fitness activities, sunbeds and other sports, leisure and community services.

Our membership and booking services are managed primarily through the Fraserburgh Fitness Centre ClubRight app and Member Area.

2. Member accounts

Members are required to provide accurate and up-to-date information when creating an account.

You are responsible for ensuring that information held on your account remains correct, including:

  • Name

  • Date of birth

  • Address

  • Email address

  • Telephone number

  • Emergency contact details

  • Relevant medical or safety information

  • Information relating to children or dependants on your account

Parents and guardians may add children or other eligible dependants to their ClubRight account and purchase memberships or make bookings on their behalf.

You must not knowingly provide false or misleading information.

3. Profile photographs

Members may be required to provide a clear and recognisable profile photograph through ClubRight.

Profile photographs are used by authorised staff and senior instructors to identify members and help ensure memberships, bookings and facility access are being used by the correct person.

Memberships are personal to the registered member and must not be shared with another person.

Profile photographs are handled in accordance with our Privacy Policy.

4. Memberships and subscriptions

Different memberships and subscriptions may provide access to different facilities, classes or services.

The facilities and services included within a membership will be displayed when the membership is purchased or explained by Fraserburgh Fitness Centre.

Members are responsible for purchasing the appropriate membership for the service they wish to use.

Memberships cannot normally be transferred between people unless Fraserburgh Fitness Centre specifically agrees otherwise.

Memberships cannot be frozen or temporarily suspended at the request of the member.

If you no longer wish to continue your membership, it must instead be cancelled in accordance with our cancellation terms.

We reserve the right to introduce, withdraw or amend membership options and pricing.

Any changes affecting an existing membership will be handled in accordance with these Terms & Conditions and applicable consumer law.

5. Martial arts memberships

Martial arts memberships may provide access to multiple suitable classes each week depending on:

  • The martial art

  • The student's age

  • Grade or ability

  • Experience

  • The class timetable

  • Instructor approval where applicable

Purchasing a martial arts membership does not guarantee that every class within that martial art will be appropriate for every student.

Some classes may be restricted according to age, experience, grade, ability or instructor approval.

Students must only attend classes that are appropriate for them.

Our instructors may move a student to a more suitable class where this is considered appropriate for safety, development or class management.

6. Class timetables

We aim to provide classes in accordance with our published timetable.

However, timetables may occasionally change because of:

  • Instructor availability

  • Competitions or events

  • Public holidays

  • Facility maintenance

  • Severe weather

  • Illness

  • Safety concerns

  • Circumstances outside our reasonable control

A membership provides access to the overall service included within that membership rather than guaranteeing that a particular individual class will take place on every scheduled date.

Where possible, significant timetable changes will be communicated through ClubRight, social media, email or another appropriate communication method.

7. Booking classes

Where a class or activity requires advance booking, members should book through ClubRight or the booking method specified by Fraserburgh Fitness Centre.

Members should only book spaces they genuinely intend to use.

Bookings must be made for the person who will actually attend the class.

A parent or guardian may make bookings for children or dependants registered to their account.

Some activities may have limited capacity.

Having an active membership does not guarantee availability in every individual class if that class has reached its permitted capacity.

8. Cancelling a class booking

If you are unable to attend a class you have booked, we ask that you cancel the booking as early as reasonably possible.

This allows another member to use the space.

Repeatedly booking classes and failing to attend without cancelling may result in booking restrictions being applied to an account where this is necessary to ensure fair access for other members.

9. Direct Debits

Where a membership is paid by Direct Debit, payment is processed by our Direct Debit provider, London & Zurich.

Fraserburgh Fitness Centre and ClubRight do not directly collect or store your full bank account details.

When setting up a Direct Debit, you are directed to the secure payment process operated by London & Zurich.

By setting up a Direct Debit, you authorise payments relating to the membership or service you have selected to be collected in accordance with the payment schedule presented to you.

Recurring monthly membership Direct Debits are collected on or around the 1st of each month in accordance with the applicable payment arrangements.

You are responsible for ensuring that sufficient funds are available for scheduled payments.

10. Failed or unpaid payments

If a scheduled membership payment is unsuccessful, your membership may become overdue or inactive.

This may temporarily prevent:

  • Gym access

  • Class bookings

  • Attendance at membership-only activities

  • Use of other services included within the membership

Where a payment has failed, you should follow the instructions provided through ClubRight or contact Fraserburgh Fitness Centre.

Any genuine payment dispute should be brought to our attention as soon as reasonably possible.

11. Cancelling a membership

Monthly memberships may be cancelled by giving Fraserburgh Fitness Centre a minimum of 7 days' notice.

Cancellation requests should be made through the appropriate ClubRight cancellation process where available or by contacting Fraserburgh Fitness Centre.

If at least 7 days' notice is provided before the next scheduled monthly Direct Debit, the upcoming payment will be cancelled where it can reasonably be stopped within the payment processing timescale.

If less than 7 days' notice is provided, the upcoming monthly Direct Debit due on or around the 1st of the month will still be processed.

That payment will be non-refundable and the membership will remain active for the period covered by that payment.

For example, if your next Direct Debit is due on 1 October, your cancellation request must be received at least 7 days before that payment date to prevent the October payment from being processed.

Simply cancelling your Direct Debit directly with your bank does not constitute cancellation of your Fraserburgh Fitness Centre membership.

You must also notify Fraserburgh Fitness Centre that you wish to cancel.

Memberships cannot be frozen or paused instead of being cancelled.

Nothing within this section removes any statutory cancellation or refund rights that apply under UK consumer law.

12. Refunds

All Fraserburgh Fitness Centre memberships are non-refundable once payment has been correctly taken.

This includes circumstances where a member:

  • Does not attend

  • Chooses not to use the gym

  • Does not attend available classes

  • Changes their mind after the applicable cancellation period

  • Is unable to make use of the membership for personal reasons

  • Cancels with less than the required 7 days' notice before the next Direct Debit

Unused days, classes or sessions within a membership cannot normally be carried forward, exchanged for cash or refunded.

A refund may, however, be provided where:

  • A payment has been taken incorrectly

  • The same payment has been taken more than once

  • Fraserburgh Fitness Centre has made an administrative error

  • A refund is required under applicable consumer law

Nothing in these Terms & Conditions affects your statutory consumer rights.

13. Changes to membership prices

Membership prices may change from time to time.

Where a price change affects an existing recurring membership, reasonable notice will be provided where required.

Members who do not wish to continue following a notified price change may cancel their membership in accordance with the cancellation arrangements set out within these Terms & Conditions.

14. Gym age restrictions

The minimum age to use the gym unaccompanied is 16.

Anyone aged 16 or over who meets our normal membership requirements may hold their own eligible gym membership and use the gym without being accompanied by an adult.

15-year-olds

A person aged 15 may use the gym only when:

  • They are accompanied by a responsible adult aged 18 or over

  • The responsible adult remains with them while they are using the gym

  • They pay the applicable Pay As You Go gym fee for each visit

  • They follow all staff instructions and gym rules

15-year-olds cannot hold their own gym membership.

They cannot use the gym unaccompanied, even where a parent or guardian has given permission.

The accompanying adult is responsible for supervising the 15-year-old while they are using the gym.

Anyone under the age of 15 is not permitted to use the gym unless Fraserburgh Fitness Centre has specifically authorised their participation as part of a supervised activity, class or programme.

Fraserburgh Fitness Centre may impose additional restrictions on particular equipment or activities where this is considered appropriate for safety.

15. Gym access

Gym access is available only to people who hold an appropriate active membership, have paid the applicable Pay As You Go fee, or have otherwise been authorised to use the facility.

Where access is provided using a ClubRight barcode, QR code or other digital access method, that access is personal to the registered member.

Members must not:

  • Allow another person to use their membership

  • Share their access code for another person to gain entry

  • Allow an unauthorised person into a restricted area

  • Misrepresent their identity or membership status

Misuse of membership access may result in the membership being suspended or cancelled.

16. Parents and guardians

Where a parent or guardian registers a child or young person, they confirm that:

  • They have authority to register the child

  • Information they provide is accurate

  • They will keep relevant medical and emergency information up to date

  • They understand the nature of the activity being booked

  • They will inform us of anything that could materially affect the child's safe participation

Children and young people must follow the instructions of coaches, instructors and staff.

Permission from a parent or guardian does not override Fraserburgh Fitness Centre's minimum age or supervision requirements.

17. Health and medical information

Physical exercise and martial arts involve physical exertion.

Members are responsible for considering whether they are medically fit to participate in the activities they undertake.

You must inform an appropriate member of staff or instructor about any relevant injury, illness, medical condition or other matter that may affect your ability to participate safely.

If you are unsure whether you should exercise or take part in a particular activity, you should seek appropriate medical advice.

Fraserburgh Fitness Centre staff and instructors cannot provide medical diagnosis or replace professional medical advice.

18. Exercise and assumption of ordinary risks

Gym training, fitness activities and martial arts naturally involve some risk of injury.

These can include risks associated with:

  • Physical exertion

  • Weight training

  • Contact activities

  • Martial arts

  • Boxing

  • Kickboxing

  • Karate

  • Judo

  • Sparring

  • Falls

  • Equipment use

Members are expected to exercise responsibly, follow instructions and use equipment appropriately.

Participation is voluntary.

Nothing in these Terms & Conditions excludes or limits Fraserburgh Fitness Centre's liability where it would be unlawful for us to do so, including liability arising from negligence where the law does not permit such liability to be excluded.

19. Martial arts training and sparring

Martial arts students must follow the instructions of their coaches and instructors.

Students must not participate in sparring or other restricted activities unless permitted to do so by an instructor.

Protective equipment must be worn where required.

An instructor may prevent or stop a student from participating where they believe:

  • The student is acting unsafely

  • Suitable protective equipment is not being used

  • The student is injured or unwell

  • The student is not yet ready for the activity

  • Continuing would create an unreasonable risk to the student or others

The instructor's decision on immediate safety matters is final.

20. Martial arts licences and gradings

Where a martial arts licence, membership, grading fee or other separate requirement applies, this may not be included within the normal monthly class subscription unless specifically stated.

Eligibility for grading may depend on factors including:

  • Attendance

  • Length of time at grade

  • Ability

  • Technical standard

  • Behaviour

  • Effort

  • Discipline

  • Instructor approval

Payment of a grading fee does not guarantee that a student will pass a grading.

Grades are awarded according to the standards set by the relevant instructors or martial arts organisation.

21. Behaviour and respect

All members, students, parents, visitors and customers are expected to treat staff, volunteers, coaches, instructors, other members, students and visitors with reasonable respect.

We will not tolerate behaviour including:

  • Violence outside the normal controlled context of supervised training

  • Threatening behaviour

  • Harassment

  • Bullying

  • Discrimination

  • Deliberate damage

  • Theft

  • Serious abusive behaviour

  • Reckless use of equipment

  • Deliberately placing another person at risk

Fraserburgh Fitness Centre may ask anyone behaving inappropriately to leave the premises.

Serious or repeated misconduct may result in suspension or termination of membership.

22. Instructions from staff and instructors

Members must follow reasonable instructions given by Fraserburgh Fitness Centre staff, coaches and instructors relating to:

  • Health and safety

  • Equipment

  • Facility use

  • Classes

  • Safeguarding

  • Emergency procedures

  • Access

  • Behaviour

Where a member refuses to follow reasonable safety instructions, they may be asked to stop the activity or leave the premises.

23. Equipment

Members must use gym and training equipment responsibly and only for its intended purpose.

Members should:

  • Return equipment after use

  • Report damaged equipment

  • Avoid deliberately misusing equipment

  • Keep training areas reasonably tidy

  • Respect other people using the facility

If you do not know how to use a piece of equipment safely, please ask a member of staff.

24. Personal belongings

Members are responsible for their own personal belongings while using Fraserburgh Fitness Centre.

We recommend that valuables are not left unattended.

Fraserburgh Fitness Centre cannot accept responsibility for loss, theft or damage to personal belongings except where liability cannot legally be excluded.

Any lost property handed to us may be retained for a reasonable period before being disposed of or donated where appropriate.

25. Damage to property

Anyone who deliberately or recklessly damages Fraserburgh Fitness Centre property or equipment may be held responsible for the reasonable cost of repair or replacement.

Serious incidents may also result in termination of membership and, where appropriate, referral to the relevant authorities.

26. Hygiene

Members are expected to maintain reasonable standards of personal hygiene when using shared facilities.

Members should:

  • Wear appropriate clean clothing

  • Use suitable footwear where required

  • Clean equipment after use where cleaning materials are provided

  • Cover open wounds appropriately

  • Avoid attending training where they have an infectious condition that could reasonably put others at risk

Martial arts students must maintain appropriate personal hygiene because of the close-contact nature of training.

27. Sunbeds

Sunbed use is subject to separate booking procedures and any additional safety requirements displayed or provided through our sunbed booking system.

Sunbeds are strictly for people aged 18 or over.

Proof of age may be requested.

Customers must follow all safety instructions provided in relation to sunbed use.

Sunbed bookings may be managed through a separate booking system linked from ClubRight.

Our Privacy Policy also applies to information handled in connection with these bookings.

28. Temporary closure of facilities

From time to time, part or all of Fraserburgh Fitness Centre may need to close temporarily because of circumstances including:

  • Maintenance

  • Repairs

  • Equipment installation

  • Safety concerns

  • Severe weather

  • Utility failure

  • Public holidays

  • Events

  • Circumstances outside our reasonable control

Short-term disruption or closure does not automatically entitle a member to a refund.

Where a significant or prolonged closure materially affects the service being provided, Fraserburgh Fitness Centre will consider the circumstances alongside any applicable consumer rights.

29. Photography and filming

Members must respect the privacy of other people when taking photographs or videos within Fraserburgh Fitness Centre.

Photography or filming must not:

  • Unreasonably invade another person's privacy

  • Take place in changing areas

  • Include children without appropriate permission

  • Disrupt classes or activities

  • Be used to harass or embarrass another person

Fraserburgh Fitness Centre may restrict photography or filming where necessary.

Any photographs used by Fraserburgh Fitness Centre for publicity or marketing will be handled separately from ClubRight membership profile photographs.

ClubRight profile photographs are for member identification and are not used for publicity.

30. CCTV

CCTV operates in areas of Fraserburgh Fitness Centre for safety, security and crime prevention purposes.

Use of CCTV recordings is governed by our Privacy Policy.

31. ClubRight app and Member Area

ClubRight is used to provide services including:

  • Membership management

  • Class bookings

  • Membership payments

  • Member communications

  • Access control

  • Account management

Members are responsible for keeping their login details secure.

We cannot guarantee that online services will be available continuously without interruption.

Temporary technical problems affecting ClubRight or another third-party service do not automatically give rise to a refund where the underlying Fraserburgh Fitness Centre service remains reasonably available.

32. Sunbed booking website and external links

ClubRight may provide a link to our separate sunbed booking system.

When following this link, members should ensure they are using the correct Fraserburgh Fitness Centre booking service.

The same Fraserburgh Fitness Centre Privacy Policy principles apply to information collected through our sunbed booking process.

33. Suspension or termination of membership

Fraserburgh Fitness Centre may suspend or terminate membership where there is a reasonable basis to do so, including:

  • Serious or repeated breaches of these Terms & Conditions

  • Abuse or threatening behaviour

  • Deliberate damage

  • Fraudulent use of a membership

  • Allowing another person to use your membership

  • Serious safety breaches

  • Persistent refusal to follow reasonable instructions

  • Unpaid membership fees

  • Behaviour that places staff, members or visitors at unreasonable risk

Termination by Fraserburgh Fitness Centre because of serious misconduct or a breach of these Terms does not automatically entitle the member to a refund.

Where appropriate, we will attempt to resolve matters before terminating a membership.

However, immediate suspension or termination may be appropriate in serious circumstances.

34. Refusal of service

Fraserburgh Fitness Centre reserves the right to refuse access or service where this is reasonably necessary for:

  • Safety

  • Safeguarding

  • Security

  • Compliance with the law

  • Enforcement of these Terms & Conditions

  • Protection of staff, members or visitors

Any decision will be made fairly and must not unlawfully discriminate against a person.

35. Emergencies and first aid

In an emergency, staff or instructors may take reasonable steps considered necessary to protect a member's health and safety.

This may include:

  • Providing first aid

  • Contacting an emergency contact

  • Calling emergency services

  • Providing relevant information to emergency services where necessary

Parents and guardians are responsible for keeping emergency contact information up to date.

36. Changes to these Terms & Conditions

We may update these Terms & Conditions from time to time to reflect changes to:

  • Our facilities

  • Membership options

  • ClubRight

  • Booking procedures

  • Payment arrangements

  • Activities

  • Safety requirements

  • Applicable laws or regulations

Where a material change affects an existing membership, we will provide appropriate notice where reasonably required.

The latest version of these Terms & Conditions will be made available through our ClubRight Member Area, app or associated online services.

37. Privacy

Personal information is handled in accordance with the Fraserburgh Fitness Centre Privacy Policy.

Members should read our Privacy Policy alongside these Terms & Conditions.

38. Your statutory rights

Nothing in these Terms & Conditions is intended to remove or restrict any rights you have under applicable UK consumer law.

If any part of these Terms & Conditions conflicts with a right that cannot legally be excluded, your statutory rights will take priority.

39. Governing law

These Terms & Conditions are governed by the laws of Scotland.

Any dispute relating to these Terms & Conditions will be subject to the jurisdiction of the Scottish courts, subject to any consumer rights that apply.
